We can help victims of domestic violence, abuse

People in the Pittsburgh metro area, including in Butler County, may think that matters of domestic violence are issues that police and criminal prosecutors handle. While that is true, and victims of domestic violence should not hesitate to contact law enforcement, family lawyers like those who work at our law office can also help prevent domestic violence an abuse, specifically by obtaining or modifying what is called a protection from abuse ("PFA") order.

Although PFA orders can apply when has experienced physical or sexual abuse or verbal threats, one can also obtain a PFA to stop stalking behavior, that is, behavior like following another person around that is clearly designed to frighten and intimidate. A PFA can also be obtained to protect children from physical or sexual abuse.

In many cases, a PFA can be issued in what is called an "ex parte" proceeding, that is, a proceeding in which a judge grants the PFA based on what the victim tells the court about the incident. However, a judge may not be willing to act without a hearing, and, in any event, the court will give the accused the opportunity to tell his or her side of the story at a hearing, usually within days or weeks of granting a PFA.

Because the court could at a hearing decide to deny, end, or considerably limit the scope of a PFA at a hearing, it may be important for a victim to have legal representation in order to ensure the court is fully aware of the domestic violence at issue. The hearing is also an opportunity for the victim to state his or her desires.
